The re-trial which began this month, centred on Mr Joseph's mental health at the time of the murder.
His defence argued that Mr Joseph was suffering from the onset of schizophrenia at the time of the incident.
The Old Bailey heard Mr Whelan, who had been travelling on the top deck of the number 43 bus with his partner Kerry Barker, 38, intervened when the accused began throwing chips Ms Barker.
Mr Whelan was stabbed through the heart and suffered six other stab wounds, the court heard.
