Police said that Mr Mackay spoke to his family on Tuesday morning but was still being treated as a missing person. Lothian and Borders Police said that they had established the wellbeing and whereabouts of Mr Mackay.

'Missing persons'
Lothian and Borders Police said they were concerned about Mr Mackay who was reported missing at 1145 BST by court officials.
Officers still do not know his whereabouts and are trying to trace him.
A force spokesman said: "He has made contact with his wife, and he told her he was well but needed some time.
"We believe him to be safe, but as with all missing persons we always want to satisfy ourselves that they are well."
Police issued a description of Mr Mackay and appealed to anyone knowing his whereabouts to get in touch.
