He said he had been asking for her or Europe Minister Geoff Hoon to appear before the committee since February. He said Mr Hoon had suggested two dates to appear before the committee in May, which were not followed up.
"We have consistently requested an early date for this evidence, so that Parliament could be better informed on the government's approach to the discussions taking place and so that ministers could hear the views of the committee."
He had "reluctantly" accepted her refusal.
'Too late'
Mr Gapes also said that Mr Hoon had also refused to appear until June which he considered "too late".
He said Mr Hoon had suggested two dates in May, which were not followed up, and June options were ruled out.

Shadow Europe minister, Mark Francois, for the Conservatives, said he agreed with the committee's criticism.
"The government has not only been secretive, they haven't even set out clear goals for Britain in the talks on a new Treaty.
"Either they don't want to tell the British people what they want to sign up to or they don't have a clue what they actually want."
