The jury in the Angelika Kluk murder trial has again been sent home due to the ill health of accused Peter Tobin. Judge Lord Menzies apologised to the eight women and seven men for the adjournment and said he hoped proceedings would resume on Monday. On Thursday the jurors were sent home at midday because Mr Tobin, 60, was ill and undergoing medical tests. Mr Tobin, who was taken to Edinburgh Royal Infirmary for observation, has denied the rape and murder of Ms Kluk. He has also denied concealing the student's body in St Patrick's Catholic Church, Anderston, in an attempt to defeat the ends of justice and giving false personal details to the police. In a special defence read to the jury, Mr Tobin has admitted having sex with the Polish student, with her consent. Three hours after the trial was due to resume on Friday, Lord Menzies told the jury: "I explained yesterday what the problem was. "That problem has not been resolved. It appears that the accused is still ill. Enquiries into that matter have not been concluded." The 15 members of the jury were asked to return on Monday morning. |
