Ian Griffin is scheduled to appear at Westminster City Magistrates' Court on Wednesday afternoon. Ian Griffin was arrested in Cheshire on Monday, one week after the body of 36-year-old Kinga Legg was found beaten to death in Hotel Le Bristol.
He was arrested in Cheshire on Monday after Kinga Legg, 36, was found beaten to death in a bath at the exclusive Hotel Le Bristol on 26 May. Mr Griffin, from Warrington, refused to give his consent to extradition during an appearance at City of Westminster Magistrates' Court on Wednesday.
Mr Griffin has now been arrested under Section 5 of the Extradition Act 2003. District Judge Daphne Wickham adjourned the hearing until 10 June.
A spokeswoman for Cheshire Police said: "The primacy for this investigation lies solely with the French authorities." No consent
Mr Griffin was arrested at 1530 BST in woodland in Chelford, Macclesfield. Cheshire Police said it appeared he had been living rough in a tent. Reading from the extradition warrant, Ms Wickham said the arrest was "in connection with this offence of murder".
He was initially arrested under Section 9 of the Offences Against the Person Act 1861. Asked if he wanted to consent to his extradition to France on Wednesday, Mr Griffin, appearing in court on his 40th birthday, refused and was remanded in custody until next week.
The section of the act covers any murder or manslaughter committed outside the UK. Stephen Vullo, representing Mr Griffin, said that his client's understanding of the European Arrest Warrant and other documents relating to his case was "unsatisfactory at this time".
Mr Vullo said he had not been able either to advise on consent for extradition, or take prepared instructions, and would therefore be advising Mr Griffin to deny consent.
Ms Legg was found dead in a suite at Hotel Le Bristol, Paris
Brian Horn, representing the French Judicial Authorities, said Mr Griffin was initially arrested on Monday but rearrested under the European Arrest Warrant shortly before 1630 BST on Tuesday.
His passport and his fingerprints confirmed his identity, the court heard.
Miss Legg's body was found by a maid "battered and bruised" in the bathroom of their hotel suite.
The Polish national died from internal bleeding as a result of her injuries, French Police said.
Mr Griffin's black Porsche 911 was recovered by police at an address in Warrington, Cheshire, where he grew up.
