The three other officers - Tou Thao, J. Alexander Kueng and Thomas Lane - will be charged with aiding and abetting second degree murder, according to the Star Tribune. The attorney general only recently took over the case at the request of Governor Tim Walz. It was previously being handled by the Hennepin County Attorney’s Office. While the three officers facing charges will likely be celebrated, some legal experts have called into question the wisdom of charging Chauvin with second degree murder, as it could be harder to prove and present more of an opportunity for him to go free.
"There's no way they will be able to prove 2nd degree murder beyond a reasonable doubt," lawyer and Human Events editor-in-chief Will Chamberlain tweeted. "Charging that is a recipe for disappointment and future protests."
Second degree murder generally means intentional murder without premeditation, while third degree murder is the killing of someone without the intent of death.
