An 81-year-old woman has escaped the threat of Christmas in jail for failing to attend a hearing over charges of harassment and breaching an Asbo. | |
Dorothy Evans, of Abergavenny, Monmouthshire, was due to be at Cardiff Crown Court on Friday. | |
A plea and case management hearing was adjourned twice during the previous week after she failed to turn up. | |
The court said notice had been received she was unwell and had been visiting her doctor. The case was adjourned. | |
Mrs Evans' barrister, Bernard Powell, had told the court on Friday that his instructing solicitor had been told Mrs Evans had been taken to the University Hospital of Wales, Cardiff, on her way to court because she was suffering from chest pains. | |
Phillip Morris, prosecuting, also told the court that this was the third time she had had the opportunity to attend court. | |
He said it was "a sensitive case given her age and the time of year," but he applied for a warrant for her arrest. | |
Mr Powell told Judge Christopher Llewellyn-Jones: "All I can do is invite you to bear in mind her age and history of deep vein thrombosis and pulmonary embolisms, which may be exacerbated by her being in a cell." | |
A spokeswoman for the court said the case, which includes six charges of breaching an Asbo, had now been adjourned until 2 January. | |
