The Christian Party's George Hargreaves is also opposing the development of the European Union, which he says will "imprison the whole nation for 42 years or more". Liberal Democrat President Simon Hughes said he hoped people would vote in the by-election - and that it had provoked debate on 42 day detention.
He said it would have been a "nonsense" for the Lib Dems to put up a candidate as they agreed with Mr Davis on civil liberties but it was "extraordinary" that Labour had not stood.
"I hope people don't stay at home even though it's a contrived election because Labour should have been there.
"Labour are the people who are arguing for the extension of the power of detention and they should have put a candidate in the field and they have bottled it."
He said he feared the turnout will be "low" but he urged voters to either back David Davis, vote for another "serious" candidate or "mark your ballot paper against 42 days".
"People have the chance to vote and I hope people do vote, even though it is a very, very unusual by-election, the like of which we have not seen in living memory."
