Driver in court after death crash

A lorry driver and a transport firm have been accused of a string of road traffic charges following a fatal crash on the A75 near Dumfries in January.

William Walker, of Annan, died after the incident near Mouswald Banks.

Fernando Rosa, 48, from Magherafelt in Northern Ireland, has been accused of driving carelessly.

Kelly European Freight Services has been accused of allowing him to use his lorry without a goods test certificate. The case was continued without plea.

Mr Rosa is alleged to have crossed into the eastbound carriageway of the A75 directly into the path of an oncoming car.

The vehicle was being driven by Callum Marshall who was seriously injured in the smash, as was his passenger Mr Walker, who later died from his injuries.

Mr Rosa is also alleged to have driven at 50mph in a 40mph limit and using a lorry with a braking system not up to the construction and use requirements.

It was further claimed at Dumfries Sheriff Court that the lorry's tyres were of insufficient tread.

The case was continued without plea for three weeks.
